No charges against dad of Brooklyn boy shot to death by 12-year-old cousin

The FDNY firefighter father of a 15-year-old boy fatally shot by his 12-year-old cousin is facing no charges after a six-week investigation.

The father, Derelle Guy, was not home when his son Jasai Guy was shot on June 2 in the family’s fifth-floor apartment on Osborn St. near Pitkin Ave. in Brownsville.

“At this time, we have no proof that the gun belonged to Jasai’s father, who was out of the country when his son was tragically shot,” a spokesperson from the Brooklyn District Attorney’s office told The News on Thursday.

The firearm was kept under the bed in a bedroom the father shared with the teen, police have said.

Cops suspect the gun belonged to the father but they have been unable to question him as he has retained legal counsel. According to police, the gun was illegally sawed off and not registered with the NYPD.

Jasai and his cousin were under their grandparents’ supervision when the shooting occurred.  The boys may have been playing with the gun but it’s unclear how they accessed it, police said. The grandfather, who was in the apartment during the shooting, did not know there was a firearm in the house.

“I didn’t mean to do it,” the victim’s cousin told first responders while Jasai was being taken out of the building on a stretcher, a neighbor recounted to The News the day of the shocking incident. Despite being rushed to Brookdale University Hospital, Jasai could not be saved.

The 12-year-old cousin is charged with manslaughter, along with charges of criminally negligent homicide and criminal possession of a weapon. His name was not released because he is underage.

Jasai’s mother, Tiffany Guy, described her late son as “a wonderful child.”

Jasai was afraid of guns and would never play with one, relatives said.

“He’s very afraid,” said Jasai’s maternal grandmother, Cassandra Vassell. “When the [Bronx D] train got shot up he didn’t go to school for a week. He wouldn’t get on the train.”

“He was an honor student,” said the victim’s aunt, Nathifa Guy. “He didn’t play with guns. It was an accident.”

Jasai, a popular basketball player in his neighborhood, dreamed of being recruited by the NBA.
