Justice Department won’t decide on charging Trump until after midterm elections: report

The Department of Justice reportedly will not formally decide whether to charge former President Donald Trump in the Mar-a-Lago documents scandal until after the midterm elections on Nov. 8.

Federal prosecutors plan to abide by the traditional unwritten edict not to take any decision or make any public announcement during the two months leading up to a major election, Bloomberg News reported Tuesday.

The investigation over Trump’s mishandling of classified documents has been moving swiftly and more details have surfaced daily.

In a normal case, prosecutors might want to move to quickly seek an indictment, especially since part of the probe involves Trump’s alleged efforts to obstruct the probe.

Any delay could give the former president a chance to further muddy the waters or figure out a way to pressure witnesses in his inner circle who apparently told the FBI that he had not handed over all the classified documents demanded in a subpoena.

But Attorney General Merrick Garland has been outspoken in his claim that his DOJ will not act in a way that could be construed as favoring Democrats.

He issued a memo in May ordering prosecutors to avoid any hint of partisan bias.

“Politics must play no role in the decisions of federal investigators or prosecutors regarding any investigations or criminal charges,” Garland wrote in that memo.
